2:18Popok:And we're going to capture and cover all the breaking news that you need to know about curated for you here on the Legal AF podcast. And right. I mean, we're just coming right off of a major hearing today in a case that I like to call Trump versus freedom of the press. And it didn't go particularly well, my perception of the hearing in front of Judge Kelly. Let me set the stage and then bring in Adam Klassfeld for his reporting on it. You've got Donald Trump, and according to reporting by CNN, getting triggered by Natalie Harp, I call her his office wife, who runs his social media platform, having given him all sorts of data about what he considers to be negative press coverage.

3:02Popok:I like to call that viewpoint discrimination coverage, showed it to him, and he immediately launched a block, whatever that was supposed to be, of CNN, MSNBC, and Politico, which left a lot of people head-scratching because he's been complaining about the media for decades. AIDS, what was the trigger now? Well, apparently, according to Caitlin Collins, it was Natalie Harp, which would explain why it was done with absolutely no due process, no letter written, no ability to cure, no, hey, we're going to take away your First Amendment rights and your press badges. Just stop covering me because I don't like what you say about me.

3:43Popok:See, there's a little thing called the First Amendment and a little thing called viewpoint-based discrimination within the First Amendment and its case law that says you can't do that. And so after filings on Monday by MSNOW, Politico, and CNN, it ended up in the courtroom with Judge Kelly. Judge Kelly was a Trump appointee from the first term, but also famously ruled in favor of Jim Acosta and CNN, citing 40-year precedent about what you can and can't not do when you're the government and you have a reporter or a reporting agency that you may or may not like. And so, you know, that was the case law.

4:22Popok:And then you've had this other weird thing where the Department of Justice at the last minute during the hearing tried to create a new due process mechanism that they hadn't used before after the fact and hoped that nobody would notice. You know who noticed? Adam Klasfeld, All Rise News, on the call, on the public feed with today's hearing. Why don't you bring us into that courtroom and then give your impression of what happened, the arguments made, and how Judge Kelly may rule? You know, my impression is exactly what your prediction was, Michael. Right from the start of the hearing, you had Judge Kelly say that I'm bound by D.C.

5:01Circuit precedent. And D.C. Circuit precedent is clear that there are two rulings on this subject, one from 1977 and one from Trump's first term, the Brian Karam case. And so these were two D.C. Circuit opinions that he's bound by that Trump cannot just simply yank away the press credentials, the White House press credentials of reporters that he doesn't like. That is, you had mentioned the First Amendment, the Fifth Amendment. There's also the due process claim. There was no process. And as you said, that right now you have the Trump administration trying to do this after the fact Alice in Wonderland process, as was described by Ted Boutros, who's representing the media organizations, where on, I believe it was Tuesday, just almost five days after the original ban, The news organizations are sent a letter that isn't on White House letterhead that doesn't have a signature and claims to have this process that they can dispute their ban by Friday.

6:13As a matter of fact, you have Michael Veltchik, who was arguing for the government, saying, Judge, Judge, Judge, don't block us. Don't issue this TRO restoring these press badges. Let this process play out on Friday. And that's, you know, he's trying to buy time. And a little bit of background about Michael Veltchik. He's the same Trump Department of Justice lawyer who, when he was in his college days, praised Hitler's Mein Kampf. And that reporting came to light by the Boston Globe during his arguing for the Trump administration in attacks on Harvard University. So that's a little bit about Michael Veltchik.

7:03But you had in this hearing the judge being heavily skeptical of the ban. This is the same judge, Tim Kelly, who had restored Jim Acosta's press credentials. The Trump administration and Trump himself are expecting to lose because of that. But Trump is framing it as, oh, this biased judge, this liberal judge. Meanwhile, Judge Kelly is one of Trump's own appointees. But they're anticipating a defeat because it's a clear violation of the Fifth Amendment right to due process. It's a clear violation of the First Amendment right against viewpoint discrimination. And there's new D.C. Circuit precedent, even as recently as this week, that some of the White House spaces, known as non-public forums, that you cannot engage in viewpoint discrimination on those types of properties.

8:01And so the precedent is against them. The judge is deeply skeptical. And we'll see if he takes action before Friday, because that's what we're at now. You have the government doing this sort of waiting game. And the media coalition saying that every day we're kept off the beat is injury for us. It's every day we lose our First Amendment right. The public loses their right to know what the White House is doing. And so that that's where we're at now. The judge did not say when he's going to rule, but it's pretty clear where he's leaning.

8:41Popok:Yeah, he's going to rule quickly because he didn't enter even an administrative stay. He's going to have to rule quickly because he has to credit what the media company's lawyer has said and the reality, which is for every day that he doesn't rule, they are blocked by this, what could be an unconstitutional, should be an unconstitutional order of retaliation by the Trump administration. Now, as expected, Donald Trump loves to push the national security button and try to cover up all of his abuse of the press by claiming some sort of right to do it under the national security principles of being the commander in chief.

9:26Popok:So I don't like the fact that there was a leak of a memo. And I don't like the fact that that, you know, things that I deem to be national security ended up being ridiculed in newspapers. You know what? That is the role of the First Amendment and freedom of the press. If they get in their hands a document, you know, whether it's the Pentagon Papers or things related to Watergate or things related to to to the operation of an administration, they are permitted to publish it. And they don't get prosecuted for national security violations. That was the late night filing by Donald Trump last night.

9:59Popok:How did the national security angle play out in the courtroom for the advocates for the Trump administration? You know, I mean, everyone knew they were going to lean on that. They've leaned on it before with the East Wing ballroom. I think that they know they're going to lose this particular battle. I don't think it went well for them. But the goal is to try to make it count in the higher court. that this, like I said, it worked for them on some level in the East Wing ballroom litigation when they were trying to restrict access to the Pentagon. Pete Hexeth leaned on supposed national security concerns.

10:43And the judge in that case said there's a national security risk in not letting reporters cover what the government does, especially what the Pentagon does. You had mentioned that, of course, the Pentagon Papers, news organizations publish restricted information all the time, all the way up to top secret, which is what the Pentagon Papers was. But some of the examples that the Trump administration gave of the supposedly national security threatening stories were based on public documents. There's one that they mentioned with MSNOW that MSNOW reported that the war in Iran had significantly depleted the U.S.

11:29military's munitions supply. That was over a public document. So the Trump administration is claiming even publicizing public records is some sort of national security risk. So this is something that they're coming up with after the fact. You know, I had mentioned that Ted Boutros, who, by the way, did represent Jim Acosta over his press access fight, he compared it to Alice in Wonderland. And it's off with your head trial to follow where you have the whole thing where the punishment has already been carried out. And the punishment was the revocation of their press credentials. And these news organizations are banned from the White House currently.

12:15They cannot access the White House. And to say, oh, well, we will have process, Your Honor, let the internal process play out and we'll decide whether a punishment should be given. The beheading has already happened in this analogy here. So I think that the judge was kind of mindful of precedent here and asking the question of forget about whether national security justifies this particular action. Could it ever justify an action? And I think that right now he is just it's clear where he's leaning. Judge Kelly is deeply skeptical of the government's case, and he's just trying to figure out what will hold up in the inevitable appeals.

13:02Popok:Well, he said out loud in the hearing, legal precedent has not been followed in this case. When a judge says legal precedent has not been followed in this case, he said, you may not agree with it. It may not be right or wrong, but I'm duty bound by a district court judge to follow it. And he's talking about cases like Cheryl versus Knight, 49 years ago, that said that you cannot discriminate based on the viewpoint expressed against a news organization. And I don't know if, you know, what I would have done during the hearing is just play clip after clip after clip of Donald Trump bashing the media because he doesn't like their reporting, because he doesn't like how harsh they are or caustic they are in their analytics.

13:40Popok:I would suggest the mainstream media is not harsh enough. But certainly, whether it's ProPublica or MSNOW, CNN, Midas Touch, Legal AF, I mean, we certainly bring a viewpoint to our and sometimes break stories related to this administration that he doesn't like. That is classic viewpoint-based discrimination, which cannot exist with the First Amendment. Now, where the Trump administration has won occasionally is on the periphery. Like when they try to ban the New York Times people like Julian Barnes from reporting on the Pentagon and being having free access to roam around that giant office building.

14:15Popok:You know, the trial court judge says, no, you've got to give them back their press credentials and let them roam freely. The appellate court was like, well, maybe we'll allow escorts to walk around the building, you know, at this point. So it's not a win, but it's definitely a little bit of a clipping back of the district court judge's decision. When it came to the Associated Press refusing to acknowledge that there was a thing called the Gulf of America in their style book, and they were then banned from all press reporting on the White House, they sued to get their press credentials back. And there was a whole debate, and this is what they're relying on, about how small is the room?

14:57Popok:If the room is really small and it's non-public, like an Oval Office or Air Force One or something else, can the Trump administration pick and choose who gets to have those limited slots? And they did give a certain amount of discretion while recognizing you still can't do viewpoint-based discrimination. If your goal is just limiting the amount of tickets and you're doing it agnostically, that's one thing. And the case that you touched on that just came out is bad for Donald Trump. It just came out in the last three days from the D.C. appellate court. It's written by a Trumper. It's written by Naomi Rao, who is trying out for the United States Supreme Court over what you can and can't do on the Capitol steps.

15:45Popok:space and the argument made by the government was it's a limited non-public space we should be able to ban and borrow wherever we want for whatever reason and she in her language reminded everybody you can't do it for viewpoint-based discrimination you you got to do it for the right and wholesome reasons or you're going to be found to have violated the first amendment when you've got even neomi reo writing like that that's got to be a sign and i'm sure judge kelly's chambers knows well about that. And as we said, it's at the top of this particular segment of our Legal AF podcast today. Judge Kelly knows his way around the First Amendment.

16:22Popok:He got Jim Acosta back his press credentials. Primarily, as you pointed out, there's a First Amendment argument, but there's also this Fifth Amendment argument, and they collided today in the courtroom. First Amendment is what it sounds like, freedom of the press, free speech, and you can't violate, you can't abridge it, Certainly the government can't because you don't like what they're saying about you. Fifth Amendment goes to the due process issue. I have a liberty right and a liberty interest. And if I have a press pass, I have a piece of property interest in doing my job as part of the press.

16:55Popok:You've taken it away from me without giving me due process. And we, if you say anything about what separates America from a lot of different countries in terms of its democracy, is this insistence on due process before things are taken away or before you're punished. And there's plenty of cases, including the ones you and I've talked about, where you can't give due process after the fact. If you block them out of the building and then say, hey, you want the key back? Here's a new process we just invented, and you have to go through it. That's why you have Judge Kelly's of the world slapping their forehead saying, that's not how that works with after the fact letters and new processes, right?

17:34Right, absolutely. And it's very clearly they're making it up as they go along. This was a letter, once again, that was dated September 22nd. CNN, MSNOW, and Politico were banned September 18th. That is notice. And the notice says, well, you have written these articles back in June, and therefore you're a national security threat. It's absurd. It's the stuff of absurdist fiction. And there's basically trying to come up with the kind of most strained plausible deniability for the inevitable appeals because you have the late night court filing that the Trump DOJ filed at, I think, 1133 p.m. last night on the eve of the hearing saying, Judge, we think that these D.C.

18:29circuit cases are wrongly decided. Just simply unserious stuff. I mean, because they're basically saying these precedents that you are bound by are wrongly decided. Okay, well, what is he supposed to do with that? And we know what he's going to do with that. Judge Kelly is going to rule against them. They're going to try to create a record for a Supreme Court supermajority who they hope will do one, just score one on their ledger. And that's what this is all about.

19:01Popok:I think you're exactly right. I think Judge Kelly is going to rule in favor of the combined media outlets. He's going to give them back their press passes. He's going to deny a request for a stay because of the harm to the First Amendment. And you're right about talking about it as a two-way harm. I have a First Amendment right. You have a First Amendment right to be heard and to do our commentary and our journalism. Our audience has a First Amendment right to hear us in the marketplace of ideas. And so it is a transaction and it is a two-way mirror that goes on with the First Amendment. He's going to have to mitigate the harm to the public and to media by denying these people the ability to report, which happens.

19:45Popok:I love J.D. Vance. It's just about who's in the room. They can still report. We're just taking away their office. He's not even up to speed on what's going on in the courtroom and lies to the public in press appearances. He's going to issue the injunction, temporary restraining order. He's going to set a hearing for the preliminary injunction. Somebody's going to jump off sides, and I mean the Trump side, and they're going to go and run to the appellate court. They're going to see what three-judge panel they get. I'm not sure it matters anymore. It used to be, well, if it's two Trumpers, like Rayo Walker and Katzis, then it's probably going to be for Trump.

20:22Popok:I'm not so sure about that when it comes to the First Amendment. Federal judges are pretty prickly when it comes to the First Amendment, regardless of who the president is. Then it's going to go to the Supreme Court. And to answer the question from our audience, there hasn't been a presidential ban block credential pulling case up to the Supreme Court in some time. The Jim Acosta thing sort of ended at the lower level with Acosta getting his credentials back. Trump has always, usually, usually in the prior administration, had folded in the face of this. The problem is Donald Trump is on a suicide mission with the Constitution.

20:59Popok:You know, he's like a kamikaze going after the Constitution in this go around. So now no one thinks he's going to back down. He's got all these different Trump TV and I got this feed and that feed. I'll just use this news organization and that news organization. He's different than he was in 2018. And so we have to expect that he's going to try to get this case, as you said, to the doorstep of the United States Supreme Court right in time for their first Monday in October reopening of the court. But before you leave, I really appreciate you coming on here, sort of last minute to cover for Karen Freeman at Nipolo, who's traveling.

21:36Popok:And thank you for doing it. I think this was a perfect way to kick off the episode. But let's take it beyond what do you think is going to happen at the D.C. Court of Appeals level? And what do you think would happen at the Supreme Court? I think the D.C. Circuit is going to honor their precedent. And by the way, I always enjoy our conversations. Michael, thank you for for inviting me. What you when it goes to the Supreme Court, you know, I can I'm stripped of my predictive powers. I did not think that birthright citizenship would be 5-4 on the constitutional issues. I think that the D.C. Circuit has been clear.

22:18I think the First Amendment has been clear. And I think the Fifth Amendment issues are extremely clear here because this is a parody of process. You had mentioned J.D. Vance earlier. I just want to call attention because there is this almost perfect illustration of George Orwell's concept of double think and double speak, where they quoted J.D. Vance saying that this is not a press ban in a quote tweet of Donald Trump saying on Truth Social that I am banning the press. And they did that on the same posting. So you have J.D. Vance saying this isn't a media ban over Trump saying I'm banning the media.

23:01That's the kind of incoherence that the Trump DOJ is going to bring to the Supreme Court. I think they are going to bring that case after losing on the lower court level, after losing on the D.C. Circuit level. And we will see what the Supreme Court does with that incoherence. So we're at least, you know, depending on your calculations, three or four justices willing to bless incoherence when it came to birthright citizenship. will they bless incoherence when it comes to this after-the-fact Alice in Wonderland idea that if I tell you about five weeks after I ban you that you are a threat to our national security and cite some old articles based on public filings, that that's enough to silence a free press?

23:53We'll see who on the Supreme Court is shameless enough to endorse that.

I want to pick up with the Don Jr. wedding scandal and so much more that it relates to. We knew from last week, ProPublica reported that Don Jr., the eldest son of the president, accepted a$250 ,000 payment, not directly from a wedding guest, not from a guy named Umar Kremlev, who is close personal friends with Vladimir Putin, who everything he has, he owes to Vladimir Putin, not to his lovely check or toaster that goes to the wedding party in this Bahamian wedding.

29:14Popok:Oh, no. It went through, according to ProPublica, it went through the International Boxing Council, which is owned and controlled by Gazprom, a energy company under the thumb of Vladimir Putin in Russia, through an offshore account in Dubai, and then got paid through the IBC to pay$250 ,000 worth of costs related to Don Jr.'s wedding on the Bahamian Island. At the time, we were like, why isn't Donald Trump attending that wedding? Maybe we know why now. Maybe because even for Donald Trump, having part of the wedding paid by Russia was too much. And what was Russia after in making the payment? See, Umar Kremlev is also so close to Putin that he's even gone as recently as last week, on a mission to visit with China, the same delegation that Donald Trump is about to visit or has set up to visit.

30:16Popok:And is that one of the reasons that the payment was made? Was that to use the soft underbelly of Don Jr. to try to soften up Donald Trump before he negotiates with the Chinese or negotiates with the Russians again about the Ukraine war? there was a quid pro quo. Nobody believes out of the generosity of his own heart that Umar Kremlev stroked a check that got money laundered through three different locations and ended up in the bank account, the wedding account, the wedding purse of Don Jr. and Bettina, his socialite wife. These two have net value, a net worth of over half a billion dollars. Russia doesn't do anything by accident doesn't do anything, I'm talking about the state, out of kindness or altruism.

31:02It wasn't

31:03Popok:like Don Jr. was short$250 ,000 for his wedding, and Putin came in through Umar Kremlov. And if Donald Trump thought in the first week of the scandal, it would die down because he'd have his attorney general take questions during a press conference when somebody said, with a noticeable Russian accent, by the way. I'm not sure what media outlet that person was from. And ask of Todd Blanche, do you think it was appropriate for the eldest son of the president to take a$250 ,000 gift from somebody so closely aligned with Vladimir Putin? And then there was that moment where Todd Blanche, what's the person's name?

31:42Popok:Trump doesn't know who it is. I think it's maybe a friend of Don Jr. What would I be investigating? I don't know. Answers to those questions that you just made. Who is the guy? Why is he at the wedding? And why is he giving money to the president's son? Start there. That would be a good idea. And then Donald Trump thought, well, we'll make it go away. We'll have Don Jr. pay it back. Like the bank robber, we'll put it back. We stole the painting. We stole the Mona Lisa from the Louvre. We'll hang it back. That's not how that works. Nor is it how it works to have your wife and Don Jr. post on her social media all in caps, we didn't do anything wrong.

32:21Popok:There's no conspiracy. There's no, right. I learned that in law school. If the person accused of a crime and of accepting a bribe just posted all in caps on their social media, they can't be guilty, right? So Donald Trump thought it would die down in week one. It hasn't. And now, as I've said in a hot take today on Legal AF YouTube, Luke, Donald Trump has a knack for creating his own destroyer. It's like a Marvel movie. He creates his own. It's like, remember in Ghostbusters, when whatever they thought about would show up to be their destroyer when they're on that rooftop? And Bill Murray's telling the other Ghostbusters, clear your minds.

33:08Popok:Don't think of anything. Don't think of anything. And all of a sudden, the giant stay-puffed marshmallow man comes around, but an evil one comes around the corner like 50 feet high, right? He says, I'm sorry, it just popped into my head. Trump always has a way of creating his own destroyer. And he did that by opposing Republican, just good old fashioned country club Republican senators in their primary bids. Cornyn in Texas, Tillis in North Carolina, well, Tillis decided to leave on his own, and Cassidy in Louisiana, but they're still around. And so they go after Donald Trump because they don't have anything to lose, like on the Epstein files or on the corruption of the Trump family, or in this case, Don Jr., accepting what appears to all thinking human beings to be some sort of bribe or payment for some service to be rendered maybe in the future.

34:03Popok:They want to get to the bottom of it. And they're joined by a fourth member of the GOP, Senator Curtis out of Utah, who has been demanding, demanding that the Senate Judiciary Committee open a hearing and immediate investigation into Don Jr. And so that's week two of the scandal. Week one is maybe we'll just act like who? What? What's the person's name? I never heard of him. You know, he paid the money back and now we've got. Yeah, that's not good enough. and I was not in the room I would love to have been to fly on the wall with Senator Cornyn of Texas or Tillis of North Carolina or Cassidy of Louisiana and their staff when this story broke in ProPublica last week because they must have been like oh we're going to have a lot of fun with this one and they've all gone on television, they've all given their clips and it's not going to happen now because we're running out of time to the midterms But sometime after the midterms, and if the Senate Judiciary Committee presided over by Grassley with the crushing focus of the Democrats doesn't open up this hearing bipartisanly, it's going to be another campaign issue for the voters to decide on come the midterms.

35:22Popok:The corruption of Don Jr. and the Trump family. Yes, we have another Russia influence case matter involving Donald Trump. Can't call this one a hoax. There is a check. There is a payment made. He paid it back. If that's not an admission of guilt, I don't know what is. so it's not just about don jr and his corruption yes he's being hoisted on his own petard yes he's the guy that led the charge against hunter biden remember oh hunter biden used his name and his dad and he set up a phone call to talk about the weather and he got several million dollars over a number of years from a couple of boards of directors in china and ukraine may have been involved.

36:07Popok:Oh, my. Oh, my. I'll tell you what Biden didn't do. He didn't take a direct payment to pay for one of his weddings or some vacation from a Russian oligarch who doesn't spend a dime without Putin's approval. He didn't do that. See, this is what happens when you get so corrupted and your judgment, if you ever had any, so impaired when you're the Trump family that you think you can get away with anything. Donald Trump once famously said he could shoot somebody on Fifth Avenue and still have his supporters. And it's now I can see, it's now leaked into the brains of his

36:52Popok:children and those in his administration who believe that they can get away with the same corruption at the same rate and the same velocity as Donald Trump himself. Now, Donald Trump may have criminal immunity granted to him by his Supreme Court. Don Jr. doesn't. And he may have a pardon in his back pocket, but that doesn't mean the Democrats aren't going to start an investigation and call him into it and expose the levels of corruption at the highest levels in the Trump family. Why should this come as any surprise? We have Don Jr. and Eric, who were at the helm of the Trump organization when Letitia James, the New York attorney general, after a trial was able to prove that they've been committing persistent fraud in the operation of their business for more than 10 years.

37:41Popok:So bad that their own auditors quit them and said nothing that we have done in the last 10 years to audit the books and records of the Trump organization, none of it can be relied upon because we were misled by our own client. There is still a federal monitor, sorry, a state-appointed former federal judge as monitor, Barbara Jones, who still sits for the next couple of months over the Trump Organization. And this is another, this is a guy who has, over the last two years, I'm talking about Don Jr. and Eric, the two sons, who have made billions of dollars in various companies, all benefited by policies made and entered into by their own father.

38:26Popok:rare earth minerals, satellites, cryptocurrency, mining, drone creation, the industrial military complex. These are all startup and standup companies that these guys invested in. And wouldn't you know it, a day before or a day after they invested, major Trump policies were changed by Trump, by the Commerce Department, by the Treasury Department, all to benefit the industries that these guys invested in, giving them billions of dollars. So when we total up the Trump crime family at the end of this administration, if not before, and draw a line under it, it's going to be tens of billions of dollars, if not a hundred billion dollars or more, which was Donald Trump's goal coming back to office.

39:17Popok:If he was going to get dragged back to the White House in order to avoid criminal conviction in jail time, that he was going to make a lot of money doing it. So when people question, why don't Trump's policies align with my interests? Why don't they benefit me? Why am I going to gas pumps that say$6 and$7 or$8 a gallon? Why can't I afford the things that I could afford even last year at the supermarket? Why are hundreds of thousands, if not millions, of Obamacare recipients being thrown off the rolls right before the midterm? Right. Why are why is inflation high and jobs low? Why am I not better off in the first two years of this administration than I was under the prior administration?

40:01Popok:And the reason for that is you have a president who is heartless, who doesn't care about you and is corrupt. And he has a family and he has family to match. The only you know, so there's a lot of questioning going on that Don Jr. under oath will have to answer. Why didn't your father go to your wedding? Was he aware of who paid for part of your wedding? What was the discussions you had? Talk to me about how that 250 came into being. What were the discussions around it? What were the emails around it and the text messages? Why didn't it come directly from Umar Kremlev? Why did it come through a series of offshore accounts?

40:40Popok:Why did it come through the International Boxing Council, controlled ultimately by Putin? Did you ever think taking a check that is directly connected to Putin was a bad thing? Did you ever think there would be a day when they would come to you and make a request of you? Did they already make that request of you? And what was it? You're not going to be able to hide behind your wife's social media account when you get hammered by the Senate Judiciary Committee led by the Democrats. And that will be a delightful moment when that happens, because the hubris and the greed of this administration and of its family members is boundless.

41:18Popok:And this is just endemic, emblematic of a greater disease that is Donald Trump, which is why with 40 whatever days left until the midterms, we have to join together and work hard to ride out this administration on the rail. It starts with a co-equal branches of government being restored. It starts with Congress being returned to the Democrats, Senate and House, oversight committee hearings, real hearings with real gavels and real subpoenas and real ability to find contempt and to put people in jail. That's what it starts with. So if you were looking for a reason to vote or to vote against the current administration.

42:06Pick one. There are dozens.

42:10Popok:The assault on the rule of law, the assault on the Constitution, the assault on the First Amendment, the assault on women's reproductive rights, the assault on immigration and migrant rights, the assault on the right of people to live freely and in liberty, like the transgender community, the gay community, the LGBTQ plus community, restoring our military, right? Restoring some sort of logic to our economic policies, our fiscal policies, our national security policies, ending the war, working on gas prices, reestablishing global relationships to make us safer and more secure, extending an olive branch to Canada and Mexico and NATO and all the other international institutions that have been damaged and almost chloroformed by this administration.

43:14Popok:Re-establish our role in the world as the moral and political leader of democracy. Help make new democracies. Help turn people away and countries away from Russia and China and turn them back towards a peace-loving power in the United States. It's a lot of work. It starts with this election and continues through 2028. So the Don Jr. scandal, one of several. I joked that if John F. Kennedy presided over Camelot, Trump presides over scandal a lot. It's all scandals. We can't get tired of them. Can't eye roll over them. We can't get fatigued. That's why we got to keep platforming them, publicizing them, spotlighting them, and then use all the levers of power at our disposal as a free people with our duly elected representatives in Congress.

44:18Popok:That's what we need to do. I'm glad you're all here together on Midas Touch and on Legal AF. Another perfect example of the power of the people and the power of free press is embodied by Katie Fang's case against Todd Blanche and on behalf of the Epstein survivors. I've said it before. I've said it again. I've got an interview up with Katie Fang right now on the Legal AF YouTube channel, like an exclusive briefing, which I think you'll really enjoy hearing it directly from Katie. I've said that Katie's case is making new law. It'll be taught in law schools, Fang versus Blanche. And the underlying case is something we don't talk about enough.

45:00Popok:Yeah, we talk about the preliminary injunction case, which is about five or six categories of documents, foreign language documents not translated, even at this late date. And 40 pages or more of FBI interview notes about an accuser of Donald Trump who says she was sexually abused when she was 13 by Donald Trump. But that's not the case. That's just the preliminary bout. The real case, that's about millions of pages of unproduced documents that weren't properly reviewed or reviewed at all by the Department of Justice and beyond. It's about how were the 3 million pages picked and what was left on the cutting room floor.

45:44Popok:We can't trust the Department of Justice to tell us those answers. We can't trust them at all. So it's about Judge Sullivan eventually, through his remedial powers, appointing a special master, another special master, who is an officer of the court, who's independent, usually a former federal judge, who will look back, do an audit, look back at the three million pages, figure out the source material and the boxes and the files and the electronic this and that, and whether that was done properly. And why were all the things, as an example, hypothetically, why are a lot of the things with Donald Trump's name on it not in that pile?

46:20It's pretty good.

46:21Popok:And then say, where's the rest? Where's the stuff you didn't produce? I want to double check it and see it and then report back to us, the victims, the survivors, and Katie Fang, the lawyers, the litigants, and Judge Sullivan. That's what's going to happen in this case, hopefully in the next six months, if not less. while we fight it out over the handwritten FBI notes about Trump and the foreign language documents. There is two new orders that came out with Judge Sullivan, which is what Katie and I are talking about. And in that case, the judge said, you're going to turn over to me the handwritten notes about the alleged victim of Donald Trump.

47:06Popok:I'm going to read them. And if I think they're responsive and are required to be produced pursuant to the Epstein File Transparency Act, I'm going to produce them. Now, they did not appeal that order. So those documents are being provided to the judge tomorrow on the 24th. One step closer to real justice for the survivors. Foreign language documents. Judge says you need to start that process of producing those. because they've already conceded that the foreign language documents are responsive, that they involve Epstein. So they've already designated, first cut, these are Epstein docs. We just don't think we have to translate them.

47:48Popok:That's not what the Epstein File Transparency Act says. If you hit a document and you don't know it's in a foreign language, just forget it. What if the entire Epstein file was in a foreign language? What if Epstein fancied himself some sort of aristocrat, and he only spoke French, and everything was in French? What if that? That wouldn't have to be produced. That's how ludicrous their position is. The judge ordered them by tomorrow to do it. They said, oh, judge, it's too hard. We want to take an appeal just on that issue. So you need to stay your order so we don't have to do it. Judge says, I'm not going to stay my order.

48:26You want to take an appeal, which they've already filed?

48:29Popok:You want to ask for a stay? Go ahead. Now, I'm still waiting as of tonight's recording, tonight's live, for the filing of the, should be any minute now, the filing of the motion to stay with the appellate court and to see who the three-judge panel is. So tomorrow, tune back in to Legal AF YouTube channel and Substack, where I will update you, because they're going to have to file it by tomorrow, or they're going to be in contempt and violation of the judge's order. So I believe that's going to happen. Again, a big date to circle on your calendar. You know, similarly, we've got a federal judge over in Judge Brinkema in the Eastern District of Virginia, just to tap on that for a moment, who did not block the order by her magistrate that the Todd Blanche-led Department of Justice have to turn over all the documents about the Jan 6 fund, its creation, and the super release and pardon that Todd Blanche gave to his boss, Donald Trump, for prior tax evasion.

49:29Popok:Those documents have to be produced, so I'm keeping an eye on that as well. It's sort of like a little bit of a programming note. Speaking of programming notes, tomorrow at the second video for Legal AF YouTube channel, I've got an exclusive interview with Attorney General Rob Bonta of California, and we walk through his settlement in the Paramount Warner Discovery case. And he was able, along with 12 other attorneys general, to obtain an amazing set of concessions that are now going to be comprised or contained in a consent decree that will be enforced by a federal judge. Not just money, that too.

50:13Commitments to bring back to the United States a lot, billions and billions of dollars of television and movie production.

50:22Popok:Right now, it's like a very small amount. It's like 5 % made in the United States, if you can believe it. It's going to be 40 % based on this deal. You know, streaming service prices are going to go down after the merger. The ticket sales in movie houses will not go up because of the merger. And production of TV and movies will happen in California, continuing to make it a billion dollar industry. But there's also a provision that because CNN and CBS are going to now fall into the clutches of that MAGA Trump supporter, the Ellison family, because they're now going to control through Paramount CBS and CNN, that there's now an independent requirement for an independent journalism monitoring board that is comprised only of journalists and not of business people that is going to sit on top of this organization.

51:18Popok:and make sure that journalists make journalistic decisions about independence. And if they don't do it, then the government, the attorneys general, are going to be able to run back to court to enforce it. Now, people are already voting, right? They're abandoning CNN and CBS, especially since the takeover. I mean, nobody's watching 60 Minutes. They just tried a big fanfare about a true crime case. Oh, we got the exclusive. We got the husband. You know what? Nobody watched it because people are like abandoning, obviously captured media that can't be relied upon. And where are they going? This is why Legal AF, Midas Touch and the rest are all going up in numbers because people are coming here because they're trusted, because we're trusted.

52:07Popok:You know, in the last 24 hours, I bumped into two people on the streets of Miami last night and this morning at breakfast where they recognized me and said, just just a one second interaction. I watch everything you do. I really trust you. And please keep it up. That was it. Both people said basically the same things. And it was very heartwarming for me. My wife was with me both times, which is also gratifying. But it shows you what is out there, not just in our community, but at the public at large, about their need for independent news media and commentary that they can rely on that's going to tell them the truth to the best of our ability, right?

52:47Popok:I mean, I'm not always right. I'm right a lot of the time. And I'll tell you, when I'm wrong, I come on and tell you, you know what? I thought the case was going to go that way. It went this way. This judge went this way when I thought he was going to, he turned right when I thought he was going to turn left. But generally, you get a good handle on those cases at the intersection of law and politics as a result. Now, back, let me wrap up Katie Fang for a minute and her case. they're going to file that motion for stay. If it's two Trump appointed judges, they may get the stay. I don't think so though, because then you're siding with, you're siding against the survivors.

53:26Popok:Supreme court hasn't wanted to do that on anything related to Ghislaine Maxwell or Donald Trump and E. Jean Carroll. And I'm not sure even the, even Trump judges on the DC appellate court are going going to want to do that either. But we'll see. If it's not to Trump judges, it's definitely not getting to stay. They're going to have to start producing foreign language documents. We will quickly translate them. I mean, we'll crowdsource it. It'll get translated through AI like almost immediately if the Trump administration doesn't do it. The reality is they're going to have to translate it and start handing this stuff out.

53:58Popok:It could be another million pages or more related to that as related to that, as even with an appeal, Judge Sullivan continues to move the case down the tracks on the broader issue of whether he's going to appoint a monitor. It may end up at the United States Supreme Court one day, and they'll make a decision about whether Katie Fang had the standing, the ability to bring this lawsuit. I think she did. I think her arguments were justified, legal arguments were justified, but we will see as that plays out. The meantime, the case moves down the track and the survivors get a measure, a modicum of dignity in that process.

54:34Popok:I'm going to talk about all that's happening in Missouri because it's going back to the United States Supreme Court on maps, if you can believe it, even though ballots are already out in Missouri. And look, I don't want to deal in hyperbole. I think there's going to be a landslide in the House. I think that the Democrats are going to take the 435 seats with a majority of 20 or 30 seats, but I don't know. It could come down to one. There are scenarios where it comes down to one seat. It could be that extra seat in Missouri. So we need to pay attention to it. I'm going to update you on what's happening at the United States Supreme Court.

I want to update everybody about what's happening with the Missouri congressional maps, we might have thought it was all over when the United States Supreme Court, for the second time, refused to intervene and ultimately blocked a federal judge's decision about which of two maps, the 2022 maps that were more favorable to the Democrats in the congressional district or the 2025 map, that was never codified.

59:48Popok:It just was a bill attached into the Missouri legislature, the 2025 maps that wiped out all the Democrats and made it a seven to one advantage in Missouri. And this matters, as I said, going into the break, because it could come down to one vote for a majority in the House. It may not, but there are scenarios. Could be 2 % chance, 5 % chance, whatever it is. We can't, we got to do everything we can to make sure that, you know, that the somehow MAGA doesn't get the majority again, which brings us back to Missouri. So after the Supreme Court, first Kavanaugh, and then the full Supreme Court said, no, effectively, use the 2022 map, not the 2025 map.

1:00:27Popok:We're too close to the election, and therefore, use your maps. Your ballots are out. What happened? The Eighth Circuit, in combination with a federal district judge in St. Louis, issued another order yesterday requiring the state to use the 2025 map. I mean, the ballots are out already, you know, with the congressional districts reflecting 2022. So now the plaintiffs in the case or the defendants of the case have rushed back to the United States Supreme Court who wanted full briefing by today about which map to use, saying effectively to the Supreme Court, there they go again, You ruled twice the Supreme Court.

1:01:12Popok:You told him to use the 2022 map and a federal judge is not listening to you, nor is the Eighth Circuit. It's the 2022 map, not the 2025 map, which gives the Democrats a fighting chance in two more districts. So instead of being seven to one, it could be five to three, which is a lot better. So now we've got Kavanaugh, who sits over the Eighth Circuit, which is Missouri, has gave his order, which said, I want full briefing by today. And sometime tonight, tomorrow, or beyond, we're going to get a ruling from the United States Supreme Court. What I think is going to happen is that they're going to block the order of the district court judge in St.

1:01:53Popok:Louis and of the Eighth Circuit. And they're going to say definitively in their order that the map from 2022 needs to be used, not the 2025 map. Why is there even a fight? In Missouri, they have a unique aspect to their constitution. If you as a voter don't like something that your legislature has done, including about maps, you can override it by signing a petition, getting 300 ,000 other voters to do it with you, and putting it up as a referendum to be voted on up or down by the voters. In California, they call it a proposition. They call it Prop 8, Prop 1. Other places call it a referendum.

1:02:35Popok:This referendum is triggered by a petition that has 300 ,000 signatures on it. They got 305 ,000 signatures. It's just that the Secretary of State, who's MAGA, even down to the red jacket that he wears, he said, oh, no, no, that doesn't apply to the maps. That's, that's, that's states have to do that pursuant to the constitution. He's right about that. I agree with his interpretation of the constitution, but it doesn't mean that the people can't override their elected officials about maps. In fact, many states have put the map issue on the ballot. So people can vote up or down as opposed to doing it in the back room in smoke filled rooms, and then shoving it down the throats of their voters, which is a lot of what a lot of other Southern states did this time around at Donald Trump's command.

1:03:25Popok:So there is no exception in the Constitution from Missouri about, well, except when it comes to maps, you can't use the referendum. No. And how do I know that? Because the highest court in Missouri, the Missouri Supreme Court, said exactly that and said it can't be the 2025 map because the referendum hasn't happened. It can only be the 2022 map. Get out of my courtroom. And then they they started contempt proceedings against the Secretary of State, who refused to follow their order and ran off to federal court, lighting the fuse on the current case, and said, we're not going to find you in contempt because you've agreed to use the 2022 map.

1:04:03Popok:Now get out of our courtroom. And he started to use the 2022 map and sent out the ballots. And then lo and behold, the Eighth Circuit decided to do its own thing again, as did the federal judge in St. Louis. And now we're back at the Supreme Court. So stay tuned to Legal AF. Stay tuned to Midas Touch and my sub stack for Legal AF, because we're going to be updating you on the story. They're going to have to make this decision in the next day or so. They have not, however, entered an administrative stay. So they're letting the time tick down. We're into the 40-day mark now for the election, for the midterms.

1:04:40Popok:I don't see the 2025 map being ordered by the Supreme Court to be used. The ballots have already been prepared under 2022. The voters are ready to vote and are starting to vote. So I think I'm going to be reporting on that. If I'm wrong, my analysis is wrong, I'll let you know. But I don't think there's five votes on the United States Supreme Court. Certainly not Amy Coney Barrett, and I'm not sure about Roberts either, or Gorsuch, to join in. The last time they issued their ruling just a week or so ago, it was unanimous. You know, it was effectively unanimous. Or in other words, there were no dissents that were published.

1:05:20Popok:I'll put it that way. So stay tuned here. Stay closely with us. Thank you for being such fervent supporters. We had a great show tonight.
