2:29Michael Popok:What is it about the Epstein Files lawsuit brought by Katie Fang that makes the Department of Justice incapable of complying with court orders, the law, or the federal rules of civil procedure? We're here on the 24th. Judge Sullivan made it clear that he wanted a couple of things to happen on the 24th, and none of them happened according to the rules or law. They were supposed to file the Department of Justice a long-awaited answer. That's the answering statement up against the original complaint that was filed, if you can believe it, way back in April. We've been waiting on that for the last six months.
3:07Michael Popok:They finally answered the suit, allowing Katie Fang to move forward in the case for summary judgment and a trial. But even in their answer, they refuse to respond appropriately to allegations. They're too busy campaigning for Donald Trump that he's the best and the greatest, the most transparent in the history of America. Put down the confetti cannon. Think about the Epstein survivors. And think about the Epstein victims for just a moment, please. And not about a political rant against what they see as another journalist that they have to attack. masquerading as an answer. That answer should be stricken from the record.
3:48Michael Popok:There should be a motion to dismiss it and to strike it because it's scandalous, it's impertinent, and it doesn't comply with the federal rules of civil procedure, even on a basic issue. An issue that we all know is before federal Judge Sullivan, the issue of the 40 or 50 pages of FBI interview notes handwritten about an accuser of Donald Trump who says she was 13 when she was sexually abused by him. That's right before the federal judge. In fact, he has the 50 or so pages produced to him by the Department of Justice for his in-camera personal review before he makes a decision to produce them.
4:25And yet in the answer, you have the Department of Justice saying, we don't know what you're
4:30Michael Popok:talking about. Missing documents, documents that were produced to Ghislaine Maxwell in her criminal case but weren't produced here. It's so vague and ambiguous. We don't know what you're talking about. You don't know what you're talking about. You're talking about an issue that is sitting in front of Judge Sullivan right now and that you already produced the documents. That's what she's talking about. And then they take a position about the death of Jeffrey Epstein. Look, there's a fair number of people in this world who think that he did not commit suicide and that he died under mysterious circumstances, the way a lot of other people associated with the Epstein scandal and sex trafficking died also.
5:07Michael Popok:But they take a position to say, oh, no, it was suicide. Really? How do you know that? That's based on an investigative report that was done by the FBI. And then lastly, they have missed another deadline. And it's not unusual. This is the fifth or sixth missed deadline by my count in this case. They missed the deadline to file their answer not once but twice. They missed the briefing schedule around the issue of when to file their answer. And they have utterly refused to produce the documents that are required. Judge Sullivan a week or so ago ordered them to produce the foreign language documents.
5:48Michael Popok:We know that Epstein had a lot of people who spoke other languages like Luke Burnell, who was the modeling agent who died under mysterious causes in a French jail? There's lots of French documents, I am sure. They were ordered to begin review and production today and to notify the court and the parties that that had happened. I looked high and low on the docket, and there is no notice filed as of yesterday, the 24th. I'll cover it all right here on Midas Touch and on Legal AF. Let's get to the answer and its deficiencies and why it should be stricken. Then we'll talk about the missing documents.
6:24Michael Popok:The complaint is where you start. It's the operative document that kicks off a lawsuit. In this case, it is 15 pages. It contains claims and counts for violation of the Epstein File Transparency Act or the Administrative Procedures Act and all of that, but it has substantive allegations. Just the ones about the missing, I'll just point you to the ones about the missing Epstein files, the missing handwritten FBI notes. So for instance, in the complaint itself, it says about their failure to comply, about the things that were not produced, including the redactions. They talk about on page eight and nine of the complaint, under the title withheld retracted or redacted documents referring to President Trump.
7:16Michael Popok:The department failed to produce required documents referring to Donald Trump and retracted previously produced documents and improperly redacted documents. What does the government say about that? Do they answer that fairly? No. They say denied. The department has complied with the law, produced millions of pages of documents. Okay, we know that's a lie. Paragraph 32, they failed to produce documents relating to Trump that other sources confirm exist. Pretty simple statement of fact. It needs to be admitted or denied under the federal rules of civil procedure. So what do we get in response? This paragraph is too vague and ambiguous to put the government on notice as to its substance and therefore it is denied.
8:01Michael Popok:The department failed to produce documents relating to Trump that other sources confirm exist. Vague and ambiguous. That should be, they should move to strike that answer and have the judge order them to file another answer or to admit it. Paragraph 33. For instance, in one document, a woman accused Trump of forcing her to perform oral sex when she was a minor. The FBI found this accusation sufficiently credible that it interviewed the alleged victim four times. What does the Department of Justice and Trump say about that? This paragraph contains sensationalized and spurious allegations entirely unrelated to the litigation and appears to be a vehicle for her plaintiff, for the plaintiff and her attorneys to attack their political opponents.
8:47Michael Popok:Katie Fang doesn't have a political opponent. She's an independent journalist reporting on the news. The fact that a witness is interviewed has no bearing on the witness's credibility. We just said that the allegations were sufficiently credible that it led to four separate interviews. To the extent any factual allegations are actually contained in this paragraph, they are denied. How can you deny that? That issue is right before the judge, squarely before him with a set of 40 or 50 pages of handwritten FD-302 FBI interview notes. 9:26Michael Popok:Play the clip. Let's try something else then. Let's try the remaining pages of the FBI documents that have not yet been provided pursuant to the Epstein Disclosure Law. As you'll recall, the travel of this was that a woman testified to FBI agents that she had been both sexually and physically assaulted by Donald Trump around the ages of 14 to 15. there were FBI 302s that resulted from those investigations, from those interviews. In the first cull, the only 302s that were released were the ones that did not mention Donald Trump. When the department was caught having held back the other ones, I think because bait stamps revealed their existence, the department then coughed up the 302s that did mention Donald Trump, but we still have 37 undisclosed pages that seem to be the contemporaneous FBI notes that would have formed the basis for the 302 summaries.
10:43Am I accurate in suggesting that those 37 pages likely include the FBI contemporaneous notes from that interview, from those interviews? We have complied with the statute and the court orders and produced three and a half million pages of documents for the first time ever. Investigators looked at the information in real time in the prior administration and made the determinations on referrals for prosecution and not. We've also repeatedly stated if there's new information, we want everyone to come forward so that we can analyze that information as to what is and isn't remaining. So what are those 37 pages?
11:22I don't know what you're referencing. We've produced three and a half million pages, and we will continue to comply with it. Yeah, but not these 37. You say there's 37 pages. My time has expired. Thank you, Chairman.

According to the logs, the redaction logs, the Department of Justice previously produced 15 documents about this alleged victim to the attorneys for Ghislaine Maxwell. But only seven documents were produced under the Epstein Act. Contemporary reporting suggests that the withheld materials include 53 pages of interview documents and notes.
13:06Michael Popok:These remain unproduced. That's a fact as alleged. Government says that paragraph is too vague and ambiguous in order to answer it and therefore deficient. For instance, the plaintiff alleges according to logs, but doesn't tell us what logs. To the extent that the plaintiff alleges it is denied as there are several grounds on which the documents are withheld. Yeah, no, that's again before the federal judge. 35. In another set of documents, a woman alleged that when she was 13, Epstein introduced her to Trump at the latter's estate, Mar-a-Lago. There, Epstein told Trump, this is a good one, huh?
13:42Michael Popok:Both men allegedly laughed, and the then girl said that she felt uncomfortable, but she didn't know why at the time. 35 says this paragraph contains characterizations of documents to which no response is required and denies it. 36 an interview with the woman was initially published on the department website but was taken down before being restored on february 19 2026 you either admit that or you deny that what do they say in response to that this paragraph contains characterization of events an interview was published and taken down and documents to which no response is required it also is vague and ambiguous because so they have to deny it to the extent that this paragraph alleges that the files posted the public facing Epstein Library are insufficient.
14:29Michael Popok:This allegation is denied. That's not the question. That's not the allegation. It goes on. Paragraph 37 of Katie's allegations. The department also retracted previously produced documents relating to Trump and then restored it after a public outcry. Response? The department has produced millions of pages. The defendant admits that discreet documents were removed from the Epstein Library. Why can't you say the name Trump? That's in the allegation. Deficient. Paragraph 37. For example, the department's first production of documents included an image of what appears to be Jeffrey Epstein's desk with two photographs of Donald Trump on it, one with Epstein and Maxwell and another with several women and revealing bathing suits.
15:17Michael Popok:It was then taken down from the website. That's a fact. What do they say in response? That's paragraph 38. Paragraph 38's response, that this consists of mischaracterizations of unidentified documents. Otherwise, it's denied. You see the problem with the answer? This answer is going to get stricken. I'm going to have Brendan Ballew, the lawyer for Katie Fang on, and maybe Katie Fang herself, to talk about their next strategy. I'm sure they're not going to like the answer. They're going to move to strike it and move to get a proper answer on file and seek sanctions as a result. Speaking of sanctions, what else is missing?
15:57Michael Popok:How about the notice to the court and to Katie Fang about the foreign language documents and the production of them? That was due yesterday on the 24th. I looked high and low. Maybe I missed it. Maybe it's still stuck with the clerk, but I don't see it. And we have a word for that. That's a violation of a court order of a federal judge who doesn't play, who has reminded the Department of Justice on more than one occasion that he's been known to find the federal government in contempt and he's willing to do it again. It was almost like the coach of the Indiana football team when he was hired, when they said, why do you think you're going to be able to turn things around in Indiana?
16:32Michael Popok:This is before he won the national championship the first year. He said, look me up, Google me. That's what the judge told them. Basically, Google me, look me up. I don't play. And we don't play either here on Midas Touch and on Legal AF. Fast moving story, lots of deficiencies in the filing, a lot more lies about the Epstein files and cover up by Todd Blanche and the Department of Justice.
