2:59Michael Popok:Well, Trump-a-palooza must not be buoying the spirits of the Department of Justice because one of its lead prosecutors, Joe DiGenova, who was leading the grand conspiracy investigation that Donald Trump was using to go after people in the Obama administration, People like John O. Brennan, former head of the CIA, people like Barack Obama, perhaps himself, or James Comey, the former FBI director, or others that was in front of and being presided over by Judge Aileen Cannon down in Florida. He resigned. He resigned today. And if you lose a true Kool-Aid drinking believer like Joe DiGenova, who was so nuts that he was kicked off of Team Crazy in the first Trump administration by Rudy Giuliani, if you lose that guy as your special prosecutor, what does that say about your grand conspiracy to try to target people because they're your political critics?

4:03Michael Popok:I'm Michael Popak. You know where you are. You're on Legal AF. Countdown to the midterms continues. Such great news coming out of the United States Supreme Court in favor of the Democrats today. Votes and maps in Missouri. We're waiting on mail-in balloting, which I think will be another win for democracy. And now we've got the news that Joe DeGeneva, the 81-year-old special counsel hired by Pam Bondi and Todd Blanche, has tendered his resignation. Now, the reporting is that the Trump administration and Donald Trump has been frustrated that DeGeneva hasn't been able to get any indictments in Florida.

4:45Michael Popok:They got their handpicked judge in Judge Aileen Cannon. Yes, the person who's likely on the United States Supreme Court shortlist that bailed out Donald Trump in Mar-a-Lago. She's presiding in her one-judge town of Fort Pierce, Florida, over a grand jury. Now, that grand jury's been around for more than six months. We know because there's been subpoenas that dozens and dozens of members of the intelligence community have been dragged in before that grand jury. And still we're waiting around and there seems to be no, no indictments. Now, DeGeneva has apparently thrown in the towel and said he's not going to do it any longer.

5:26Michael Popok:Now, if you don't know who I'm talking about, here is Joe DeGeneva in his prime when he went on Fox News and other right wing media outlets going after James Comey and John Brennan and the rest. Now, you should know that John Brennan, the former CIA director, is fighting back and has filed multiple motions in advance of him being indicted to try to make sure that the government doesn't destroy documents. And I mean you, Joe DiGenova. Here's a clip of Joe DiGenova in action. Like prisoners putting checks on a concrete wall, we like to mark the passage of time on this show. And as of today, Robert Mueller's investigation into Russia has been running for an entire year.

6:11What have we learned? Joe DiGenova has been taking close notes from day one. He's a former U.S. attorney, of course, one of our favorite guests. He joins us tonight with a recap. Joe, what do we know? We know that Hillary Clinton was illegally exonerated. We knew that a year ago. We know that there was a substantial effort to frame the current president of the United States with crimes by infiltrating his campaign and then his administration with spies that the FBI had set upon them. We have learned that the crimes were committed by the FBI, senior members of the Department of Justice, John Brennan, Mr.

6:49Clapper, Mr. Comey, and others associated with the Democratic Party, and that Donald Trump and his associates committed no crimes. That's quite a litany. So So to the spying question, when the president tweeted that one morning, I'll never forget it. Yes. They spied on us from Trump Tower. And I don't think there's a single person who read that who thought, well, that's kind of a heavy duty charge. Can you prove it? And of course, he was derided immediately as insane and as a tinfoil hat guy. That's in effect been proved. Oh, absolutely. Categorically and unequivocally, it has been proved that the FBI, in violation of all guidelines, all legislation, and I believe they committed crimes in doing so, purposely sent people into the Trump campaign to plant false information, then force that information to be forwarded back to CIA and then funneled to the FBI to be used as false information in FISA applications.

7:43Everybody involved in that process who knowingly participated committed a crime. So why aren't they being held to account? As of today, I understand that a referral for criminal prosecution has been made by Mr. Horowitz to Mr. Huber, who is investigating the FISA leaks, the unmasking, the leaks of the unmasking and everything we described tonight. Criminal referrals have already been made. And I suggest that Mr. Brennan, who loves to make comment about the process, get himself a good lawyer, not a good writer.

8:16Michael Popok:So I know Trump made a big deal out of, oh, Michael Cohen was in the audience and we've got Fetterman, the senator, doing a video or whatever he did. But you see, this is like a smokescreen and a cover for a complete lack of any type of professionalism or continuity within the Department of Justice. When you lose Joe DiGeneva, who has been a MAGA enabler and a Trump supporter from day one, that tells me that the case against these people in the quote unquote grand conspiracy tying them all together is weak. How are they ever, for instance, going to indict Barack Obama? First of all, how are they ever going to indict these people down in Florida?

9:00Michael Popok:There's been recent Supreme Court cases that say, point blank, wherever the scene of the crime is, is where you have to prosecute them. What crimes did Barack Obama commit that aren't covered by presidential immunity by the Supreme Court in Florida? What crimes did Brennan commit in Florida? Doesn't live in Florida. Or James Comey, the former FBI director, or anybody else. You can't just use a master grand jury located in front of a friendly court and a friendly judge to spit out indictments and print up indictments. That's not the way our system of justice or democracy works. Now, I don't know.

9:38Michael Popok:We'll find out because this is a very leaky administration. I don't know if DeGeneva was bristling under having to report to Todd Blanche directly or he was being pressured to bring indictments and he's been capable of doing it. You know, we've had subpoenas that have apparently gone out. There's been testimony and yet no indictments. So this is important because the key to Donald Trump's anti-weaponization department of the Department of Justice rests on the shoulders of a few people. One of them was Ed Martin, who used to be the pardon attorney, was the head of the anti-weaponization committee for Pam Bondi, and had for a very short time been the acting U.S.

10:23Michael Popok:attorney in the District of Columbia. Eagle Ed Martin was also out there going after all of Donald Trump's political critics and his self-proclaimed targets, like Letitia James, New York Attorney General, and James Comey again, and Adam Schiff, Senator from California. And so he just left the government. Now they try to make it have a good appearance. Like, oh, he's going to go out and help protect the Trump and Trump elected officials and elected officials in MAGA to make sure that, you know, the election coming up at the midterms is properly protected. Is that really what happened? Or did he also leave because he can't accomplish any of the goals that Donald Trump had set for him?

11:11Michael Popok:So you got Ed Martin leaving. You've got the rumors that Jeanine Pirro, the U.S. attorney for D.C., is about to leave. And now you've got Joe DiGenova, who's being shown the door or shown himself the door. It's very odd. It shows you how corrupt the underlying premise of the indictments is. And the fact that Joe DiGenova, either because he's frustrated he can't get a grand jury to indict on this kind of false or fabricated evidence or whatever smoke they're blowing in that grand jury room. Or he's frustrated because Trump's on his ass to get the indictments that he's incapable of delivering them.

11:47Michael Popok:Either way, it tells a story about what's going on with the corruption of the Department of Justice under Todd Blanche. So we're going to continue to follow it. This is not the first report I'm going to be doing. As new information comes out, I will update you about that grand conspiracy investigation, whether they try to put somebody else in charge of that. Maybe they try to revive Alina Habba or try to bring in somebody else from the extended MAGA world to be the special prosecutor or not. And Joe DiGeneva can't help himself. He will pop up on network television on some sort of right-wing media show any day now, and we'll be there to capture it.
