5:05The Trump Justice Department catches Duke Law School discriminating against white and Asian applicants. The Department of Justice's Civil Rights Division has concluded that Duke University's School of Law intentionally discriminated against white and Asian applicants on the basis of race when admitting students to its 2023, 2024, and 2025 classes. The discrimination is ongoing. In a letter dated August 6th, the DOJ found that Duke violated Title VI of the Civil Rights Act of 1964. Duke is one of the most selective law schools in the country, 6 ,240 applicants competing for 227 places in the latest published figures, with 804 offers extended.

The data was damning. In 2025, a black applicant had roughly 3.5 times the probability of admission as an Asian applicant with comparable LSAT scores and undergraduate records. In both 2024 and 2025, the median LSAT scores of rejected Asian and white applicants exceeded those of admitted black applicants.

7:47Black and Hispanic applicants enjoyed a substantially greater likelihood of admission than equally qualified white or Asian candidates. The DOJ therefore found that Duke systematically discriminated against applicants from other racial groups in order to boost black and Hispanic enrollment. Assistant Attorney General Harmeet Dillon was clear. Duke does not get a free pass to discriminate against white and Asian students because of what it considers good intentions. Using diversity essays to identify applicants from preferred racial groups remains unlawful. Duke said it is reviewing the findings carefully and remains committed to complying with the law while pursuing its academic mission.

8:36Under federal civil rights law, the DOJ must first seek a voluntary agreement to bring admissions into compliance before going to court. Beyond any government enforcement action, the findings open the door to private lawsuits. The DOJ explicitly concluded that highly qualified white, Asian, and other applicants were denied admission because of their race. That analysis of individual data and internal communications could become powerful evidence if rejected applicants decide to sue. This is exactly what the Trump administration promised, enforcing the Supreme Court's colorblind ruling instead of letting elite universities keep discriminating under new labels.

The 409-page document never defines women, offers no policy on transgender eligibility, and does not say whether self-identification alone is enough. Freedom argued that if declaring an identity is sufficient, he qualifies.

11:41White said the league could end the challenge by simply stating its position on biological men in women's sports. I think the WNBA could come out and make a definitive statement about guys with a pair of balls playing in the women's association. Both men say they will proceed unless the league clarifies. If they go undrafted, White vowed to sue for discrimination. The issue exploded last month when Indiana Fever guard Sophie Cunningham blasted transgender participation. I want to protect young girls in a locker room or young girls in sport who shouldn't have to go against biological men. She later called her comments common sense while insisting there is room to love everyone.
